t**t in a Transit! VS my Wing mirror

So this happened on the way home. The muppet in the Transit went passed me at a rate of knots and hit my mirror. Did stop and say " sorry these things happen " then got in his van and buggered off.

The main mirror frame looks undamaged as does the glass and the motor still works bottom cover needs replacing but the main cover only gas one clip half broken and is also scratched all over.

So my question is:
Would you keep the top cover and have it painted or replace with a new one already painted?

( new genuine cover painted from T4srus is £88.00 )

Also can anyone see any other damage that I've missed?

Where do you stand legally with this sort of thing? Is it deemed knock for knock? My mirror got hit on the day I picked up the van, luckily the glass fell out but was held by the heater cables. I've now fitted a dash cam. I guess that helps if he was in the middle road. But I assume something has to be obviously there fault to make any sort of a claim?

It normally goes 50/50 from past experience and it normally will cost you more in excess then the cost of paying for it yourself and then you also have a fault claim on your file even if 50/50.

That's just from what my experience is others may be different
 
As above typically a 50/50 unless parked but just for clarity, witnesses have to be independent so his mates word would not of counted.
 
Not good! A Lorre nearly did the same this evening on the way home! Road was wide enough and he appeared to head for me on purpose!
 
He is a chancer. If you were a big burly geezer his reponse may have been different.
 
Its always good to put your phone on record/video before any conversations at side of road
 
Because the mirrors tend to twist up rather than fold in are they more likely to get knocked off rather than let's say a transit mirror that can just get pushed in towards the van.
I've never had such an immaculate vehicle before and it seems everything is out to mark, scratch or break something.
